Abstract
Analyses both the historical development of anti-suit injunctions and their rationale. Considers whether the opposition towards anti-suit injunctions in civil law jurisdictions is justified by examining their role in matrimonial causes and insolvency proceedings. Assesses the value of the anti-suit injunction in contemporary cross-border commercial litigation, and discusses what common law states could learn from the German approach to its use.
