Abstract
The purchase price resulting trust applies whenever property is purchased by one party with funds provided by another. Although prima facie this concept appears to be uncomplicated and easy to apply, the high profile and controversial Petrodel v Prest litigation challenges the purchase price resulting trust’s uncomplicated nature and raises a number of issues as to its application.
